Terms of Use
These Terms of Use (“Terms”) govern your access to SpiritTonic.com and related services operated by FitWell.Life LLC (“Spirit Tonic,” “we,” “us,” or “our”). By accessing or using the site, you agree to these Terms. If you do not agree, do not use the site.
1. Current stage of the brand
Spirit Tonic and Clarity Tonic are in development. Product concepts, packaging, ingredients, benefits, pricing, availability, locations, and timelines displayed on the site are preliminary and may change. Nothing on the site constitutes an offer to sell a product unless a purchase option and final terms are expressly presented.
2. Eligibility and acceptable use
You must have legal capacity to agree to these Terms. You may use the site only for lawful purposes. You may not interfere with site operation, attempt unauthorized access, introduce malicious code, scrape the site in violation of law, impersonate another person, or use the site to violate another person’s rights.
3. Waitlists and communications
Joining a waitlist does not guarantee product availability, pricing, priority, admission to an event, or the right to purchase. When you request email updates, you authorize us to send the communications described at the point of signup. You may unsubscribe from marketing emails at any time through the link provided in those messages.
4. Health and wellness information
Site content is provided for general informational and educational purposes only. It is not medical advice and is not intended to diagnose, treat, cure, or prevent any disease. Consult a qualified healthcare professional before using any future product, especially if you are pregnant or nursing, have a medical condition, take medication, or have questions about ingredients or interactions.
5. Future purchases
When ecommerce becomes available, purchases may be subject to additional terms presented during checkout, including product, subscription, shipping, return, refund, and cancellation policies. If those checkout terms conflict with these Terms regarding a purchase, the more specific checkout terms will control.
6. Intellectual property
The Spirit Tonic name, Clarity Tonic name, site design, text, graphics, photographs, product concepts, logos, and other content are owned by or licensed to FitWell.Life LLC and are protected by applicable intellectual-property laws. You may view the site for personal, noncommercial use. No other use is permitted without our prior written authorization.
7. Third-party services
The site may use or link to third-party forms, CRM tools, payment processors, ecommerce platforms, social networks, or other services. We do not control their independent services, availability, content, or terms. Your use of them may be governed by separate agreements.
8. Disclaimer of warranties
To the fullest extent permitted by law, the site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the site will be uninterrupted, error-free, secure, or that all content will remain accurate or current.
9. Limitation of liability
To the fullest extent permitted by law, FitWell.Life LLC and its owners, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, or inability to use, the site. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.
10. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless FitWell.Life LLC and its owners, affiliates, contractors, and service providers from claims, losses, or expenses arising from your unlawful use of the site or violation of these Terms.
11. Governing law
These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Any dispute that is not subject to another written agreement will be brought in a court of competent jurisdiction in Missouri, unless applicable law requires otherwise.
12. Changes and severability
We may update these Terms by posting a revised version with a new effective date. If any provision is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of that provision.
